2. Service Description

Troccy is an online barter marketplace that facilitates direct item exchanges between users. Our Platform allows users to:

• Post items for trade with detailed descriptions and photos
• Search and browse items available for exchange
• Propose and negotiate trades with other users
• Utilize secure payment processing
• Access integrated shipping services or arrange personal delivery
• Manage digital wallet for cash supplements and platform fees

We provide the platform and facilitate transactions, but we are not a party to the actual exchanges between users.

3. Eligibility

To use Troccy, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Verify your email address and optionally your phone number
• Comply with all applicable laws and regulations
• Not be prohibited from using our services under applicable law

Users under 18 may use the Platform only with the supervision and consent of a parent or legal guardian who agrees to be bound by these Terms.

4. User Accounts

Account Creation

You must create an account to access most Platform features. You agree to:

• Maintain and update your information to keep it accurate

Account Security

5. Trading Rules and Policies

Item Listings

• All listed items must have an estimated value of €100 or less
• Provide accurate descriptions and current photos
• Items must be legally owned by the poster (proof may be requested)
• No counterfeit, stolen, or illegal items
• Condition must be accurately represented

Trade Process

All trades follow this standard process:

1. Trade proposal with item selection and optional cash supplement
2. Negotiation period through secure messaging
3. Acceptance of final trade terms
4. Payment of shipping fees and preparation for shipment
5. Shipping or personal delivery
6. Receipt confirmation by both parties
7. Automatic completion

Trade Protection

To protect all parties, we could:

• Debit your credit card for an amount equal to the estimated value of items received
• Funds could be effectively taken only in case of dispute resolution

Trade Cancellation

• Free cancellation before items are shipped
• User credibility score may be impacted for excessive cancellations
• Return process available with mutual agreement after delivery
• In case of fraud suspicion, penalty fees may apply

Commitment of Parties

Both parties commit to cede their property rights to the items being traded upon acceptance of the trade agreement. This commitment becomes binding once both parties confirm the trade terms and conditions.

6. Payments and Fees

Payment Processing

All payment processing is handled securely through our payment partner.

Platform Fees

• Basic trading is free for all users
• Transaction and shipping fees may apply to secure trades
• Featured listing fees for enhanced visibility
• Payment processing fees as per our payment partner rates

Digital Wallet

Users may maintain a digital wallet for:

• Adding cash supplements to trade proposals
• Paying for featured placement fees
• Receiving cash supplements from other users
• Storing funds for future transactions

Refund Policy

Refunds are processed according to our dispute resolution procedures. Pre-authorizations are automatically released for cancelled or completed trades.

7. Shipping and Delivery

Shipping Options

Troccy offers two shipping methods:

Shipping Responsibilities

• Items must be shipped within 3 business days of trade acceptance
• Proper packaging to prevent damage during transit
• Accurate shipping addresses and contact information
• Insurance recommendations for valuable items

Delivery Confirmation

Users must confirm receipt or report an issue within 2 days of delivery. Failure to confirm may result in automatic trade completion.

8. Prohibited Activities

Users are strictly prohibited from:

Illegal Activities

• Trading illegal, stolen, or counterfeit items
• Money laundering or fraud of any kind
• Violating any local or state laws
• Trading items restricted by law or regulation

Platform Misuse

• Creating multiple accounts to circumvent restrictions
• Manipulating ratings or review systems
• Spamming or sending unsolicited messages
• Attempting to bypass security measures
• Using automated scripts or bots

Prohibited Items

• Weapons, explosives, or dangerous items
• Drugs, alcohol, or controlled substances
• Adult content or sexually explicit materials
• Stolen or fraudulently obtained items
• Items that infringe intellectual property rights
• Animals or living creatures
• Hazardous or toxic materials

Consequences

Violation of these prohibitions may result in:

• Warning or temporary account suspension
• Permanent account termination
• Forfeiture of consignment deposits
• Legal action if applicable
• Reporting to relevant authorities

9. User Content

Content Ownership

You retain ownership of all content you post on the Platform, including photos, descriptions, and messages. However, by posting content, you grant Troccy a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for Platform operations.

Content Standards

All user content must:

• Be accurate and truthful
• Not infringe on others' intellectual property rights
• Not contain offensive, harmful, or inappropriate material
• Comply with all applicable laws and regulations
• Not contain personal information of third parties

Content Moderation

Troccy reserves the right to review, moderate, and remove any content that violates these Terms or our community standards. We may also use automated systems to detect and prevent policy violations.

10. Dispute Resolution

Platform Mediation

In case of trade disputes, Troccy provides mediation services to help resolve issues fairly. Our dispute resolution process includes:

1. Initial dispute reporting with evidence submission
2. Automated review for clear-cut violations
3. Human mediation for complex cases
4. Final resolution with appropriate remedies

11. Limitation of Liability

Platform Role

Troccy is a platform that facilitates connections between users. We are not a party to the actual trades and do not take possession of traded items. We provide tools and services but cannot guarantee the quality, safety, or legality of items or the truth of user representations.

Liability Limits

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) €100 OR (B) THE FEES PAID BY YOU TO TROCCY.

Indemnification

You agree to indemnify and hold Troccy harmless from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Termination

Termination by You

You may terminate your account at any time by contacting customer support. Upon termination, you remain liable for any pending trades and obligations.

Termination by Troccy

We may suspend or terminate your account immediately for:

• Violation of these Terms
• Fraudulent or illegal activity
• Multiple policy violations
• Security concerns
• Extended inactivity

Effect of Termination

Upon termination, your access to the Platform will cease, but certain provisions of these Terms will survive, including payment obligations.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email and platform notifications. Continued use of the Platform after changes constitutes acceptance of the new Terms.

You are responsible for regularly reviewing these Terms. If you do not agree to any changes, you must stop using the Platform and may terminate your account.
